1. Object and Acceptance

These terms govern the use of the Odha service, published by 25 lignes, a limited liability company with a capital of €1,000, registered under number 920817434, with its registered office at 2 impasse Magritte, 85500 Les Herbiers, France (hereinafter "the Publisher").

By creating an account and using the service, the User acknowledges having read, understood and unreservedly accepted these terms in their entirety. If the User does not accept these terms, they must refrain from using the service.

2. Description of Service

Odha is a task management, planning and time tracking tool designed for independent workers. The service enables users to plan their days, log time spent on projects, and generate activity reports.

Full access to the service requires a paid subscription, monthly or annual, after a 15-day free trial period. At the end of this period, the User must take out a paid subscription to continue accessing the service. No automatic charge is made without the User's explicit and voluntary action.

3. Limitation of Liability

Best efforts

The Publisher undertakes to make all reasonable efforts to ensure the availability and continuity of the service. However, the service is provided "as is" and "as available." The Publisher cannot guarantee uninterrupted availability of the service.

Data loss

Although regular backups are performed, the Publisher cannot be held liable for loss of data, files or any indirect damage resulting from a technical failure, a hosting infrastructure fault or misuse by the User. It is the User's responsibility to regularly export their data using the dedicated function available in the application.

Commercial loss

The Publisher cannot be held liable for any loss of profits, revenue or clients suffered by the User due to a temporary unavailability of the service, an error in generated reports, or any other service failure.

Liability cap

In any event, if the Publisher's liability were to be engaged, the total amount of compensation shall not exceed the sums actually paid by the User during the six (6) months preceding the event giving rise to the dispute.

The limitations and exclusions of liability set out herein apply to the extent permitted by law and shall not exclude the Publisher's liability in cases of gross negligence, wilful misconduct or where the law prohibits such limitation.

4. Acceptable Use

The User agrees to use the service in compliance with applicable laws and regulations and with these Terms and Conditions.

The following are prohibited in particular:

  • any fraudulent, unlawful use or use that infringes third-party rights
  • the dissemination, storage or processing of illegal, defamatory, hateful, violent or public-order-violating content
  • any attempt to intrude upon, disrupt or abusively exploit the service or its infrastructure
  • use of the service for spam, phishing, fraud or the distribution of malicious software.

The User remains solely responsible for:

  • the content, data and information they import, create, transmit or use via the service
  • compliance with legal, regulatory, tax, accounting or professional obligations related to their activity.

The Publisher cannot be held liable for content published or used by Users, nor for damages resulting from use of the service contrary to these terms or applicable law.

In the event of reasonable suspicion of unlawful, fraudulent or abusive use of the service, the Publisher reserves the right to immediately suspend or terminate access to the service, without notice or refund, and without prejudice to any legal action.

The Publisher may also remove any manifestly unlawful content and cooperate with competent authorities where required by law.

5. Right of Withdrawal

In accordance with the applicable consumer protection regulations, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium, whose performance has begun with the User's prior express agreement.

By creating an account and accessing the service, the User expressly acknowledges waiving their right of withdrawal and accepts that performance of the contract begins immediately.

6. Pricing and Payment

Prices shown are inclusive of all taxes and are automatically converted to the User's local currency at the time of purchase. Payment and currency conversion are managed by our reseller Paddle.com. The Publisher reserves the right to modify its prices at any time.

For new subscribers, the prices displayed at the time of subscription apply. For existing subscribers, any price change will be notified by email at least 30 days before it takes effect. Without explicit objection from the User within this period, the new prices will be deemed accepted as of their effective date.

The ordering process is managed by our online reseller Paddle.com. By purchasing an Odha subscription, you enter into a contract with Paddle.com acting as Merchant of Record. No banking data is stored by Odha. The User is subject to Paddle's general terms available at paddle.com.

7. Termination and Refund

Termination

The User may cancel their subscription at any time from their account settings, in one click, at no cost and without explanation. Cancellation takes effect at the end of the current billing period. The User retains access to the service until that date.

Monthly subscription

Upon cancellation, no refund will be issued for the current month, as the service has been made available to the User for the full period.

Annual subscription

In the event of early cancellation of an annual subscription, no pro-rata refund will be issued, except in cases of technical error attributable to the Publisher. The User retains access to the service until the end of the paid annual period.

Exceptional refund

In the event of a billing error or major technical failure attributable to the Publisher, a refund or credit may be granted upon a reasoned request using the contact form available on our website.

8. Data Protection (GDPR)

Data controller

25 lignes, 2 impasse Magritte, 85500 Les Herbiers, France.

Data collected

The Publisher collects only the data necessary for the operation of the service: email address, planning and task data entered by the User, and billing data transmitted to Paddle.

Legal basis for processing

Data is processed on the basis of contract performance (Article 6.1.b GDPR) for data necessary to provide the service, and on the basis of the Publisher's legitimate interest for anonymised usage data used to improve the service.

Hosting

Data is hosted in Europe by Neon / AWS Frankfurt, in compliance with GDPR requirements. No data is transferred outside the European Economic Area.

Cloudflare Turnstile

We use Cloudflare Turnstile to protect our website against automated abuse and malicious traffic. Turnstile may process technical information such as IP address, browser headers, and browser characteristics in order to determine whether a visitor is a human or a bot. This data is processed by Cloudflare in accordance with their privacy policy and Turnstile Privacy Addendum.

Data ownership

The User retains full ownership of all their data. Odha does not sell any data to third parties and does not use any advertising trackers.

Retention period

Data is retained for the duration of the active subscription. Upon account closure, data is deleted within 30 days, unless a legal retention obligation applies.

User rights

In accordance with the GDPR, the User has the right to access, rectify, delete, port and object to the processing of their personal data. These rights may be exercised using the contact form available on our website. In the event of an unresolved complaint, the User may contact the relevant data protection authority.

9. Intellectual Property

All elements of the Odha service (source code, interface, logo, texts, design) are the exclusive property of the Publisher and are protected by French and international intellectual property laws.

Any reproduction, representation, modification or exploitation, in whole or in part, of these elements is prohibited without the prior written consent of the Publisher.

Data entered by the User remains their exclusive property. The Publisher acquires no rights over this data.

10. Force Majeure

The Publisher's liability cannot be sought if the performance of the contract is delayed or prevented by a force majeure event, including: general internet network failure, fire or major failure of hosting infrastructure, natural disaster, government decision or any other external, unforeseeable and irresistible cause.

In the event of force majeure, the Publisher will inform the User as soon as possible and will endeavour to restore the service as quickly as possible.

11. Mediation and Disputes

In the event of an unresolved dispute, the User may seek free recourse to a consumer mediation service. These terms are governed by French law. In the event of a dispute, an amicable resolution will be sought first. Failing that, the competent courts in the jurisdiction of the Publisher's registered office shall have sole jurisdiction.

12. Amendments

The Publisher reserves the right to modify these terms at any time. The User will be informed of any material change by email at least 30 days before it takes effect. Continued use of the service after that date constitutes acceptance of the new terms.
